Marriage After Divorce
Yes, you can get married after divorce.
What we need
Before the marriage can happen, we need evidence that the divorce is final.
This is usually a:
- divorce order
- certificate of divorce
- decree absolute, if it is an older record
If your divorce is still pending
You can still give a NOIM while a divorce is pending.
On the NOIM, the status can be recorded as divorce pending.
But the marriage cannot be solemnised until we have sighted evidence that the divorce is final.
If the divorce happened overseas
We may need to see the overseas divorce documents, and sometimes more supporting material if there is any doubt about whether the divorce is recognised.
If that happens, legal advice may be needed.
Best timing advice
If your divorce is not yet final, do not plan the marriage for a date that depends on wishful timing. Give yourself room for delays.
